To all men to whome this present wryting shall comme I Iohn Bixon of the parish of St Saviour in Sowthwark in the countye of Surrye
gardiner send greeting in
our lord god euerlastinge Whereas Thomas off Stone of the parish of
St Saviour in Sowthwark afforesaid yoman by his Indenture of lease bearinge date the
xxjth daie of August 1578 & in the xxth yeare of the
raigne of our soueraigne ladie Elizabethe the
Queenes Mayestye that nowe is for the consideracion therein
expressed did demise graunt betake & to ferme lette vnto Richard Ballarde of the
parish & countye aforesaid hosier All that garden plott with
thappurtenaunces sometimes parcell of the Olde Beare garden sett lyeing &
being in the said parish of St Saviour in Sowthwark aforesaid then in the
tenure or occupacion of the said Rychard Ballarde in as lardge & ample
manner & forme as the said Rychard then helde and occupied the same To have
& to holde the said garden plott before mentioned to be demised in as large
& ample manner & forme as abovesaid to the said Richard Ballard his
executors & assignes from the feast of St Michell Tharchaungell then last past before the Date of the same
Indenture vnto thende & terme of Sixteene yeares from thence nexte insueinge
& fullie to be compleate & ended for such yearlye rent & vnder the
performaunce of such other agreement as in the same
indenture is mentioned & expressed as in & by the same more plainelie maie
appeare Thinterest estate & terme of yeares of which said Rychard
Ballard of & in the said garden plott is nowe sithence by paroll
conveyed & assigned over vnto me the said Iohn Bixon Nowe knowe ye that I the
said Iohn Bixon for & in consideracion of the soome of ffortye three
shillinges and fowre pence of lawfull english monie to me before the
ensealing hereof in summe paid by Morgan Pope Cittisen & goldsmith of London wherof I acknowledge my selfe by these
presentes fullye satisfied, have bargained sold
assigned & sett over & by theise presentes doe fullie
clearlye & absolutelye bargaine sell assigne sett over & assure to the said
Morgan As well the saide Recited Indenture of lease, as also all thestate Right
title Interest claime propertye & demawnd whatsouer
of me the said Iohn Bixon of in & to the said garden plott by virtue of the said
Indenture assignement by paroll or otherwise howsoeuer To have
& to hold the said garden plotte & all my said estate right title interest
clayme propertye & demaunde aforesaid togither with
the said Indenture from the daie of the date hereof forthward during all the
residewe yett to come vnexpired of the said terme of xvj yeares graunted in
& by the said Indenture of lease And I covenaunt promyse &
graunt for my selfe my executors & admynistratoures
to & with the said Morgan Pope his executoures &
assignes by theise presentes that the said Indenture is a good
lawfull & effectuall indenture of lease and that the same standeth nowe in full
force & virtue & that I have good right true title & lawfull aucthorytie
to bargaine sell assigne sett ouer & assure the same in manner
& forme as aforesaid And moreouer that he the said Morgan ‸⸢his executors & ‸ ⸢assignes⸣⸣ for & sonder the payment of the
yearlie rent which from henceforth shall growe due & payeable in &
by the said Indenture of lease shall or maye lawfullye peceably & quietlye have
hold occupie & enioye the said garden plott without anie lawfull lett
suite troble eviccion expulcion interrupcion or putting
out of or by the saide Thomas Stone Rychard Ballard or me the said Bixon or anie of
vs, our or anie of our executours admynistratoures or
assignes or anie other person or persons whatsoeuer
during all the redidewe yet to come vnexpired of the said terme of xvj yeares
graunted in & by the said Indenture of lease In Wytnes Whereof I have
hereunto put my seale the fiveth daie of October in the xxixth yeare of the raigne
of our said soueraigne ladie Queene Elizabeth &c/

In the St Saviour's vestry minutes for 28 November 1586, it was noted that Morgan Pope agreed to pay tithes for the Bear Garden and the ground adjoining; see St Saviour's Vestry Minutes, 1586.

Thomas Stone in August 1578 had leased a garden plot to Richard Ballard, for sixteen years at 20s annually. This plot was described as having been part of the 'old Beare Garden'; see Thomas Stone's Lease of a Plot in the old Bear Garden to Richard Ballard.The plot had subsequently been conveyed at some point to John Bixon, gardener. On 5 October 1587 Bixon assigned the seven years remaining of the sixteen years in the lease to Morgan Pope, who since December 1579 had held a lease of the Bear Garden; see Edward Bowes v. John Digges and John Gape.
